  obtaining and transferring land use rights
   

Means by which land use rights are obtained:
(1) Granting of a state-owned land use right: With the approval of the government and in accordance with the law, the applicant for land use is given the land use right after paying compensation and relocation fees etc. or, in some circumstances, receives the right of land use at no cost.
(2) Transfer of a state-owned land use right: The state transfers the state land use right to the applicant for a fixed number of years and the land user pays the state transfer fee for the land use right. The transfer fee is the price of the land use right.
(3) Investment by the State in a reorganized or newly established enterprise: The state grants a state-owned land use right for a certain period of years to a reorganized or new enterprise. The enterprise can transfer, lease or mortgage the land use right pursuant to applicable administrative laws and regulations.
(4) Lease of a state-owned land use right: Requires the land user to sign a land lease contract for a certain term of years with the land administrative department above county level and to pay the required rent, if any.
