Applying for customs recordation is the first step for any patent rights holder to obtain effective customs protection for a patent. Upon obtaining a patent, the rights holder should immediately request inclusion of its patent in the file of the General Administration of Customs. After customs recordation, and within the rights scope on file, China’s customs agents can, on their own, inspect imported or exported goods which are suspected of infringing IP rights. |
